The Centers for Disease Control (CDC) issued a new residential tenant eviction moratorium on Tuesday, August 3, 2021. The new CDC moratorium expires on October 3, 2021 – but may be extended, similar to the initial moratorium.

Oklahoma Eviction Moratorium

The new moratorium affects Oklahoma residential landlord-tenant relationships and leases in counties that have “substantial” or “high” levels of COVID-19 spread. Check and see whether your county is impacted on the CDC’s County View tracker. At the time of this article, only Alfalfa and Beaver Counties are below the order threshold; Alfalfa has a “Moderate” transmission level and Beaver County has a “Low” transmission level.

This means all 75 other counties in Oklahoma fall subject to the new eviction moratorium. Counties on the list include Oklahoma County, Tulsa County, Cleveland County, Canadian County, and Logan County. Landlords may not gain possession through eviction proceedings called “forcible entry and detainer” proceedings in Oklahoma.
